PLEASE READ THESE TERMS CAREFULLY. By downloading, accessing, or using the Dump Zip mobile application, website, and related services (collectively, the "Platform" or "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
1. The Nature of the Service (Venue Only)
Dump Zip is strictly a passive communications venue and scheduling tool. We provide a digital bulletin board that allows users to post available jobs and users to post available trucks.
Not a Motor Carrier, Broker, or Dispatcher: Dump Zip is not a motor carrier, freight forwarder, broker, or logistics provider. We do not provide transportation services, we do not employ drivers, and we do not dispatch, coordinate, arrange, or select vehicles or carriers for any user. Dump Zip's role ends entirely at the point of communication between users. Any transportation that occurs as a result of users connecting through the platform is solely the undertaking of those users.
"Bookings" are User Memorandums: Any "Booking" created within the App is strictly a user-generated scheduling request. The App provides a logistical framework, but the decision to operate, route, deploy, and safely conduct any vehicle or transportation service remains solely with the equipment owner and operator. Dump Zip exercises no control — and has no knowledge of, involvement in, or responsibility for — the means, methods, safety, or execution of any transportation services arranged between users.
No Agency: Use of the App does not create an employer-employee, agency, partnership, or joint venture relationship between any User and Dump Zip.
Not a Broker — Revenue Model Confirms It: Dump Zip charges nothing, and when fees are introduced in the future, they will be a flat subscription solely for access to software. Dump Zip does not receive, and will never receive, any commission, percentage, or fee tied to any individual booking, load, or transaction between users. This is an intentional and permanent architectural decision. Dump Zip is a bulletin board, not a broker.
No Selection, Recommendation, or Influence: Dump Zip does not rank, recommend, or select carriers for contractors. All search results are sorted by objective criteria only. The decision to hire any truck owner is made solely and independently by the contractor. Dump Zip's display of any truck listing is not an endorsement, recommendation, or safety certification of any kind, and shall not be construed as influencing or contributing to any hiring decision.
2. User Accounts & Responsibilities
You must register to use the App. You agree to provide accurate, complete, and updated information.
Account Security: You are strictly responsible for all activity that occurs under your account.
Responsibility for Account Activity: You are solely and fully responsible for all activity that occurs under your account, including any individual who operates your equipment or accesses the App under your account, whether expressly authorized by you or not. If a third party uses your account or equipment to fulfill a Booking and causes damage or injury, you agree to fully indemnify Dump Zip. Dump Zip assumes no supervisory, oversight, or management role over any user's account activity, equipment operation, or transportation conduct.
Right to Terminate: To comply with App Store guidelines and maintain a safe venue, Dump Zip maintains a zero-tolerance policy for abusive behavior, harassment, or fraudulent activity. We reserve the right to suspend or terminate your account at any time, without notice or liability, for any reason.
3. Specific Obligations for Hauling (Truck Owners/Drivers)
When you use the App to accept a Booking or offer equipment for hire, you represent and warrant that:
Insurance Warranty & Ongoing Attestation: You possess and will maintain at all times valid commercial auto liability insurance that meets or exceeds all applicable state and federal minimums. This obligation is continuous and unconditional — it is not triggered by, and does not depend upon, any platform prompt, automated reminder, or system notification. You agree to periodically re-certify within the App that your insurance and DOT authority remain current when prompted. Dump Zip does not independently verify this certification. The warranty of insurance accuracy rests solely with you, at all times, regardless of when you last attested.
Attestation Acknowledgments: When prompted by the App, you must affirmatively confirm that your commercial insurance and DOT authority are current before continuing to use the platform. Failure to do so may result in restricted access to platform features. These acknowledgments are binding representations. Dump Zip's decision to prompt, not prompt, or experience any technical failure in prompting you does not diminish your underlying warranty obligation in any way.
Regulatory & Environmental Compliance: You possess all necessary licenses, permits, and FMCSA authorities.
Cargo Liability Waiver: You acknowledge that Dump Zip assumes no liability for loss, damage, or delay of cargo.
Safe Operation & Distracted Driving: You expressly agree never to interact with the App while your vehicle is in motion.
Indemnification: You agree to defend, indemnify, and hold harmless Dump Zip and its officers, employees, and agents from and against any and all claims, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or relating to your transportation operations, your equipment, your drivers, or any third-party personal injury or property damage claim connected to any Booking facilitated through the platform. This obligation survives termination of your account.
4. Specific Obligations for Posting Jobs (Contractors)
When you use the App to post a Job or request equipment, you represent and warrant that:
Safe Sites: The job location, access points, and any specific instructions you provide are safe and suitable for heavy commercial vehicles.
Clearance & Routing Liability: You are solely responsible for ensuring the route has adequate clearances (weight, height, terrain).
Independent Carrier Vetting: You bear sole and non-delegable responsibility for independently verifying the safety fitness, FMCSA authority status, insurance coverage, and regulatory compliance of any truck owner before engaging them through the platform. The FMCSA SAFER database is publicly available at safer.fmcsa.dot.gov. Dump Zip does not verify FMCSA ratings, safety scores, insurance status, or any other safety credentials, and nothing on this platform — including any listing, rating, or search result — constitutes an endorsement, recommendation, or safety certification of any carrier. The presence of any truck owner on this platform is not a representation of their safety fitness, legal compliance, or suitability for any job.
Acknowledgment of Vetting Responsibility: You will be required to affirmatively acknowledge that you have completed your own independent carrier vetting. This acknowledgment is binding. Dump Zip's role in facilitating communication between users does not reduce, replace, or share in your independent obligation to vet any carrier you choose to engage.
Indemnification: You agree to defend, indemnify, and hold harmless Dump Zip and its officers, employees, and agents from and against any and all claims, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or relating to your selection of any truck owner, your job site conditions, or any third-party claim connected to any Booking you initiate through the platform. This obligation survives termination of your account.
5. Fees, Subscriptions & Payment
Subscription Plans: Dump Zip is currently available at no charge. In the future, certain features or levels of access may require a recurring subscription fee. Any such fee will be strictly for access to the software platform — never a commission, percentage, or fee tied to any individual booking or transaction. Users will be given advance notice of any fee changes. Continued use of the platform after such notice constitutes acceptance of the new fee structure.
No Refunds: Dump Zip does not provide refunds for partial months or unused services.
6. Financial & Employment Disclaimer
No Payments Between Users: Dump Zip does not facilitate payments. All financial agreements are strictly between users, off-platform.
Time Logs are Estimates: Any timestamps generated by the App are for scheduling convenience only. They are not certified payroll records.
7. MASTER DISCLAIMER OF WARRANTIES
THE APP AND ALL RELATED SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. DUMP ZIP EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUMP ZIP SHALL NOT BE LIABLE FOR ANY INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE PLATFORM. FOR CLAIMS ARISING FROM DISPUTES BETWEEN USERS REGARDING SOFTWARE ACCESS OR SCHEDULING FEATURES, LIABILITY IS CAPPED AT THE AMOUNT PAID BY THE USER TO DUMP ZIP IN THE THREE MONTHS PRECEDING THE CLAIM, OR $100.00 DURING ANY PERIOD IN WHICH THE PLATFORM IS PROVIDED AT NO CHARGE. NOTWITHSTANDING THE FOREGOING, NOTHING IN THESE TERMS SHALL LIMIT LIABILITY FOR PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM TRANSPORTATION OPERATIONS CONDUCTED BY USERS, WHICH REMAIN SOLELY THE RESPONSIBILITY OF THE USERS WHO UNDERTAKE THEM. DUMP ZIP EXERCISES NO CONTROL OVER ANY TRANSPORTATION OPERATION AND ASSUMES NO LIABILITY THEREFOR.
9. General Provisions
Governing Law: These Terms shall be governed by the laws of the State of Kentucky.
Arbitration: Any dispute shall be resolved exclusively through binding arbitration in Kenton County, Kentucky.
